    Default 99 Year lease?

    Any thoughts on a 99 year lease....Is it all that bad?

    It is a 50x100 foot lot in Masachopa, I really do not have any details except that the lease is with the Alcaldias. Who ever the people who "lease" the land have not paid the taxes in many years....

    I know many people in Masachopa/Pochomil who have beach property that is a 99 year lease and no one seems to have any problem with that. I have always been very skeptical about that type of deal, I know it is very common in Mexico and people do not seem to care(?)

    Am I afraid of having the land confiscated, yep, but the reality is no one and especially Gringos have that guarantee. My husband always says "Don't ever take anything to Nicaragua that you don't mind loosing"

    Does the lease expire when you do?

    Can it be transferred to your heirs

    Important questions..

    If it can not then it should temper greatly what you build.

    Best thing is to get a copy of the lease agreement, have it carefully translated to English, and see if anything jumps out at you.

    Not that the rule of law means much in Nicaragua, but at least you'll know fully what the piece of paper says, which may be more than the owner or Alcaldia thinks they know.

    Seems like "99 years" means any problems can be dealt with "manana" or "not today."

    I took a 15 year lease out on the property where I have my house and it is due next year, now I took it out with the Karata Indian Land management office and they are well known to be a bit one sided on things (read this they change their laws at will to suit themselves)

    But I had a good local lawyer that I trusted and still do make the contract. There in nothing in the contract that say's I have to pay Karata 10% of my improvments on the land if I sell, He saw to that good. But we did make the contract in Dollar value and I hope that continues with the renewal.

    My Wife and myself also have a joint contract with them on another piece that adjoins this one and it was done in Cordobas and for 5 years only. This year when I went to renew it, it was cut and dried same contract conditions but for the same amount of Cordobas, which means I am paying less and they are missing out on the money loss of value in the Cordoba de-valuation. They said nothing about it and I didn't either...
    To be called a "Has Been" I must surmise, is much Greater than to be called a "Nevah Been"... JW...
